การเตรียมความพร้อมก่อนปล่อยและติดตามดูแลภายหลังปล่อย

Abstract

การวิจัยเรื่อง “การเตรียมความพร้อมก่อนปล่อยและติดตามดูแลภายหลังปล่อย” เป็นการศึกษาถึงแนวทางและวิธีการที่ได้ผลและเกิดประสิทธิภาพในการเตรียมความพร้อมก่อนปล่อยและการติดตามภายหลังปล่อยให้กับผู้ต้องขัง เพื่อเป็นต้นแบบที่ดีให้กับกรมราชทัณฑ์ได้นำไปปรับใช้ต่อไป โดยวัตถุประสงค์ในการศึกษาวิจัยนี้คือ เพื่อศึกษาปัญหาและอปสรรคในการเตรียมความพร้อมก่อนปลอยและการดูแลภายหลังปล่อยในปัจจุบัน และเพื่อศึกษาแนวทางการสงเคราะห์ในการเตรียมความพร้อมก่อนปล่อยและการติดตามภายหลังปล่อยที่สอดคล้องกับสภาพของผู้ต้องขังในยุคปัจจุบัน วิธีการศึกษา เป็นการศึกษาวิจัยเชิงคุณภาพ (Qualitative Research) โดยการศึกษาค้นคว้าจากเอกสาร (Documentary Research) และการศึกษาข้อมูลภาคสนาม (Field Research) โดยการสัมภาษณ์เชิงลึก (Depth interviews) เจ้าหน้าที่กรมราชทัณฑ์ และผู้ที่ได้รับการพักโทษ/ผู้ต้องขังที่เข้าร่วมโครงการเตรียมความพร้อมก่อนปล่อยและติดตามดูแลภายหลังปล่อยในโครงการกำลังใจ ในเรือนจำชั่วคราวแคน้อย จังหวัดเพชรบูรณ์ และเรือนจำชั่วคราวเขาระกำ จังหวัดตราด และการประชุมกลุ่มสนทนา (Focus Group) กับผู้ทรงคุณวุฒิซึ่งประกอบด้วย ผู้บริหารระดับสูงและเจ้าหน้าที่กรมราชทัณฑ์ กรมคุมประพฤติ และนักวิชาการทางด้านอาชญาวิทยาและกระบวนการยุติธรรม ผลการศึกษาพบว่ามีปัญหาและอุปสรรคในการเตรียมความพร้อมก่อนปล่อยและการดูแลภายหลังปล่อยในปัจจุบัน ทั้งทางด้านนโยบายและกฎหมายด้านเจ้าหน้าที่ผู้ปฏิบัติงาน ด้านกิจกรรม/โปรแกรมเตรียมพร้อมก่อนปล่อย ด้านสวัสดิการสำหรับผู้ต้องขัง และด้านการปรับเปลี่ยนพฤติกรรมผู้ต้องขัง ข้อเสนอแนะจากการศึกษาเสนอว่า ควรมีการแก้ไขปรับปรุงนโยบายและกฎหมายยาเสพติดของประเทศไทยอย่างเหมาะสม ควรผลักดันให้มีการบัญญัติกฎหมายเฉพาะในการเตรียมพร้อมก่อนปลอยและการสงเคราะห์หลังปล่อยสำหรับผู้กระทำผิดในกระบวนการยุติธรรม (Pre-release and Post-release/Aftercare Service Program) อย่างครบวงจร ควรมีเจ้าหน้าที่เฉพาะที่มีทักษะความรู้สูงในการประเมินความเสี่ยงที่จะกระทำผิดซ้ำ (Offender Risk Assessment - OA) กับผู้ต้องขังก่อนปล่อยทุกคน ระยะเวลาการจัดกิจกรรม/โปรแกรมเตรียมความพร้อมก่อนปล่อยโดยเฉพาะโครงการกำลังใจควรอยู่ระหว่าง 6-12 เดือน โดยขึ้นอยู่กับประเภทความผิด พฤตินิสัยของผู้ต้องขังเป็นรายบุคคล ควรมีการจัดแบ่งเฉลี่ยเงินปันผลที่ได้จากรายได้ของการฝึกวิชาชีพของผู้ต้องขังอย่างเพียงพอ ควรเพิ่มกิจกรรม/โปรแกรมเตรียมความพร้อมก่อนปล่อย ที่จะทำให้ผู้ต้องขังเห็นคุณค่าในตนเอง รู้สึกสำนึกผิดในสิ่งที่ตนเคยกระทำ สามารถสร้างแรงจูงใจในการทำความดีให้มากขึ้น ควรมีการประเมินความเสี่ยงและความต้องการจำเป็นของผู้กระทำผิดที่มีคุณภาพและมีความแม่นยำก่อนปล่อยตัวออกไปสู่สังคม และควรมีพื้นที่ในการจัดกิจกรรมหรือโปรแกรมการเตรียมความพร้อมก่อนปล่อยเนื่องจากบางเรือนจำมีพื้นที่จำกัด A study on “Prerelease and Aftercare Service Programs of Prisoners” is the research concerning guidelines and effective methods in the prerelease and aftercare service programs for offenders in order that the Department of Corrections will have some good practices for implementing change. The objectives of this study are to study problems and obstacles in the prerelease and aftercare service programs for offenders and how to provide them with assistance before and after the release that consistent with the conditions of the prisoners in present. The method of study is qualitative research (documentary research and field research with in-depth interviews). Representative samples are officials at the Department of Corrections and the prisoners participating in the prerelease and aftercare service programs of the Inspire Project at Khae Noi Temporary Prison, Phetchabun Province and Khao Rakam Temporary Prison, Trat Province. Focus Group from Corrections Department’s officials, Probation’s Department’s officials and some scholars in criminology and criminal justice administration was conducted. The results show that there are problems and obstacles in prerelease and current aftercare programs as follows, both in policy and law, staff Activity / prerelease program, Welfare for ex-prisoners, and the aspect of changing prisoners’ behavior. Recommendations from the study suggest that there should be appropriate amendments to policy and drug laws of Thailand. Specific legislation to provide prerelease and post release / Aftercare Service Program for offenders in the criminal justice process should be enacted. Specialized staff with high knowledge and skills in Offender Risk Assessment (OA) should be appointed. The duration of activities / preparation programs before releasing, especially encouragement projects, should be between 6-12 months, depending on the type of offenses and individual prisoners’ behavior. There should be a sufficient distribution of dividends from the income of vocational training of prisoners. Activities in prerelease programs focusing on generating selfesteem of prisoners, and make them feeling remorse for what they had done, should be added. The risk and needs of the offender should be assessed with quality and precision before being released into society. Finally, there should be enough space for activities of prerelease programs in prisons because most prisons have limited areas.
