การศึกษาโอกาสและการพัฒนาสิ่งอำนวยความสะดวกทางการค้า (Trade Facilitation) ในกลุ่มประเทศ CLMVT (กัมพูชา สปป.ลาว เมียนมา เวียดนาม และไทย) (A Study on the Implementation and Development the Trade Facilitation in the CLMVT Countries (Cambodia, Lao PDR, Myanmar, Vietnam and Thailand)

Abstract

ในช่วงระยะเวลาหลายปีที่ผ่านมาการเจริญเติบโตทางการค้าและการลงทุนระหว่างประเทศไทยกับประเทศกลุ่มประเทศ CLMV มีการเจริญเติบโตอย่างต่อเนื่อง ส่งผลให้ไทยกลายเป็นประเทศคู่ค้าที่มีความสำคัญต่อประเทศเพื่อนบ้านในกลุ่ม CLMV อย่างไรก็ตามในปัจจุบันการอำนวยความสะดวกทางการค้าในกลุ่มประเทศ CLMVT ยังคงเผชิญกับอุปสรรคในการเคลื่อนย้ายสินค้าข้ามพรมแดนระหว่างกันส่งผลให้เกิดมีต้นทุนทางการค้าและระยะเวลาที่สูงขึ้นโดยไม่จำเป็น ซึ่งส่งผลกระทบต่อการค้าและการลงทุนระหว่างกลุ่มประเทศ CLMVT ในการศึกษาคณะผู้วิจัยได้มีการทบทวนงานวิจัยที่เกี่ยวข้องกับการอำนวยความความสะดวกทางการค้า การเก็บขอมูลโดยการสัมภาษณ์เชิงลึกผู้มีส่วนเกี่ยวข้องในกลุ่มประเทศ CLMVT การจัดประชุมระดมความคิดเห็นกลุ่มย่อยจากทั้งผู้เชี่ยวชาญ ตัวแทนจากหน่วยงานภาครัฐ ภาคเอกชนและผู้มีส่วนได้เสีย เพื่อให้ทราบถึงสถานการณ์ ปัญหาและอุปสรรคต่างๆ ที่เกิดขึ้น และการวิเคราะห์ประโยชน์และโอกาสด้านการค้าและการลงทุนรวมกันภายในกลุ่มประเทศ CLMVT โดยใช้การพัฒนาสิ่งอำนวยความสะดวกทางการค้าเป็นกลไกขับเคลื่อน รวมทั้งการเสนอแนะแนวทางต่างๆ เพื่อนำไปสู่การพัฒนาการอำนวยความสะดวกทางการค้าเพื่อผลประโยชน์ร่วมกันของทุกประเทศ ผลการศึกษาพบว่า การพัฒนาด้านการอำนวยความสะดวกทางการค้ายังคงมีระดับการพัฒนาที่แตกต่างกันไปในแต่ละประเทศ ซึ่งส่งผลกระทบให้เกิดอุปสรรคทางการค้าในด้านต้นทุนและระยะเวลาที่ไม่จำเป็นในการเคลื่อนย้ายสินค้าข้ามพรมแดน การใช้การอำนวยความสะดวกทางการค้าเป็นกลไกขับเคลื่อนเพื่อให้เกิดประโยชน์และโอกาสด้านการค้าและการลงทุนรวมกันภายในกลุ่มประเทศ CLMVT จำเป็นจะตองมีการส่งเสริมและพัฒนาให้แต่ละประเทศสามารถปฏิบัติตามมาตราตามความตกลงว่าด้วยการอำนวยความสะดวกทางการค้าใน Category A ได้อย่างพร้อมเพรียงกัน ซึ่งจะก่อให้เกิดสภาพแวดล้อมการค้าที่มีความน่าเชื่อถือแก่ผู้ประกอบการ ข้อเสนอแนะของแนวทางการพัฒนาการอำนวยความสะดวกทางการค้าร่วมกันภายในอนุภูมิภาค ได้แก่ 1) การมีบทบาทและส่วนร่วมของไทยในฐานะประเทศผู้นำ รวมทั้งการสนับสนุนเชิงเทคนิคและการพัฒนาขีดความสามารถให้แก่ประเทศเพื่อนบ้านในอนุภูมิภาค 2) การจัดตั้งคณะอนุกรรมการว่าด้วยการอำนวยความสะดวกทางการค้าในอนุภูมิภาคภายใต้กรอบ ACMEC 3) การร่วมกันกำหนดนิยามและขอบเขตที่ชัดเจนในการจัดหมวดหมู่ในแต่ละ Category ในความตกลงว่าด้วยการอำนวยความสะดวกทางการค้าภายใต้องค์การการค้าโลก 4) การร่วมกันจัดทำคู่มือแนะนำการปฏิบัติตามความตกลงว่าด้วยการอำนวยความสะดวกทางการค้าภายใต้องค์การการค้าโลก และ 5) การดำเนินการตามแนวปฏิบัติของอนุสัญญาโตเกียวฉบับปรับปรุงขององค์การศุลกากรโลก These past few years, trade and investment growth between Thailand and the CLMV countries has been continuously increasing. This causes Thailand to become an important partner country for the CLMV countries. However, trade facilitation among the CLMVT countries is currently still impeded by the movement of goods across borders. This leads to unnecessary trading costs and overtime. As a consequence, it affects trade and investment among the CLMVT countries. In this study, the research team reviewed many researches relating to trade facilitation. Next, the team gathered information by in-depth interview with relevant stakeholders in the CLMVT countries. The team also arranged a focus group including experts, government agencies, the private sector and stakeholders to acknowledge existing situations, problems and obstacles. Then, the team analyzed trade benefits, trade opportunities and CLMVT internal investment by using trade facilitation development as a mechanism. Lastly, the team discussed suggestions, policies and measures at various levels to shape trade facilitation development in order to afford mutual benefits for the CLMVT countries. Results show that there is a level of trade facilitation development in each country that is different. Thus, this difference brings trade obstacles in terms of unnecessary cost and overtime when moving goods across borders. Therefore, to provide trade facilitation as a mechanism to create trade and investment opportunities in the CLMVT countries, members are required to implement the provision of WTO TFA in Category A simultaneously. Hence, this will create a reliable trading environment for traders and stakeholders. Suggestions for sub-region trade facilitation development are as follows: 1) Thailand needs to play a major role and participate in trade facilitation as a leader as well as provide technical assistance and capacity building (TACB) to sub-region neighboring countries. 2) Sub-region Committees on Trade Facilitation need to be established under ACMECS. 3) The WTO TFA must be explicit and state clearly what it sets out to do that leaves no doubt or indecision in each category for the CLMVT countries to fulfill. 4) WTO TFA Implementation Guidelines need to be created 5) The Revised Kyoto Convention (RKC) of World Customs Organization (WCO) should be followed.
