ศึกษาเพื่อเตรียมความพร้อมในการดำเนินการตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 และยกร่างอนุบัญญัติในส่วนที่อยู่ในหน้าที่และอำนาจ และภารกิจของกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม (ร่างกฎหมายตามมาตรา 78 และร่างประกาศกระทรวงตามมาตรา 81)

Abstract

งานวิจัยเรื่องนี้มีวัตถุประสงค์คือ ศึกษาแนวคิด หลักเกณฑ์เพื่อยกร่างกฎกระทรวงตามมาตรา 78 และร่างประกาศกระทรวงตามมาตรา 81 ของพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 โดยมีวิธีการศึกษาวิจัยเอกสารและเก็บรวบรวมข้อมูล รับฟังความเห็นของผู้มีส่วนไดเสีย ผู้ทรงคุณวุฒิ และพนักงานเจ้าหน้าที่ที่เกี่ยวข้องกับการจัดการทรัพยากรน้ำ ทั้งในภูมิภาคและในกรุงเทพมหานคร และดำเนินการระหว่างเดือนตุลาคม 2562 ถึงเมษายน 2563 ผลการศึกษา คณะที่ปรึกษานำแนวคิดในการอนุรักษ์ จัดการ และคุ้มครองแหลงน้ำสาธารณะในประเทศสาธารณรัฐเกาหลีและประเทศญี่ปุ่นซึ่งมีหลักเกณฑ์ใกล้เคียงกับประเทศไทยมาปรับใช้ และนำหลักการอนุรักษ์อย่างยั่งยืน การคุ้มครองมลพิษทางน้ำ และการมีส่วนรวมของประชาชน ชุมชนมาใช้เพื่อกำหนดหลักเกณฑ์การอนุรักษ์และพัฒนาแหล่งน้ำตามมาตรา 78 หลักเกณฑ์ที่กำหนดในร่างกฎกระทรวงตามมาตรา 78 แยกออกเป็นการอนุรักษ์และพัฒนาทรัพยากรน้ำสาธารณะที่ต้องใช้และพัฒนานาอย่างยั่งยืน การใช้น้ำต้องไม่ก่อให้เกิดอันตรายแก่ทรัพยากรน้ำหรือการเสื่อมสภาพของน้ำ กำหนดหน้าที่ให้แก่ผู้ใช้น้ำบริเวณแหล่งน้ำสาธารณะที่จะก่อสร้าง ติดตั้งอุปกรณ์หรือใช้กรรมวิธีในการตรวจวัดคุณภาพน้ำภายใต้การสนับสนุนของหน่วยงานของรัฐที่เกี่ยวข้อง ให้อำนาจอธิบดีกรมทรัพยากรน้ำที่จะสั่งรื้อถอนสิ่งปลูกสร้างที่ก่อให้เกิดอันตรายแก่แหล่งน้ำสาธารณะและจ่ายค่าทดแทนการรื้อถอน รวมถึงหลักเกณฑ์การอนุรักษ์หรือพัฒนาอื่น ๆ ที่รัฐมนตรีว่าการกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อมจะกำหนดตามมาตรา 78(5) ต่อไป ส่วนการร่างประกาศตามมาตรา 81 เป็นการกำหนดแบบบัตรประจำตัวพนักงานเจ้าหน้าที่ของกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม ซึ่งรัฐมนตรีว่าการกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อมจะเป็นผู้ออกโดยมีแบบเช่นเดียวกับบัตรประจำตัวพนักงานเจ้าหน้าที่ตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 ที่ออกโดยกระทรวงอื่นที่เกี่ยวข้องเพื่อมิให้ประชาชนสับสน นอกจากนี้ในงานวิจัยนี้ ได้นำเสนอเขตพื้นที่แหล่งน้ำสาธารณะที่ควรอยู่ในการดูแลของกรมทรัพยากรน้ำแนวปฏิบัติที่ดีในการดำเนินการตามพระราชบัญญัติน้ำ เจ้าพนักงานระดับใดควรได้รับแต่งตั้งเป็นพนักงานเจ้าหน้าที่และกลไกการส่งเสริมให้ประชาชนมีส่วนร่วมในการอนุรักษ์และพัฒนาแหล่งน้ำด้วย This research has aimed to study concepts and doctrines for drafting regulation under section 78 and drafting notification under section 81 of Water Resource Act of B.E. 2561. The methodology of this research has been done in both documentary and qualitative collecting information and interviewing others partnerships, experts and states authorities relating to water resources managements in all part of Thailand and Bangkok during October B.E. 2562 to April B.E. 2563. As the research outcome, our researcher team has introduced concepts of sustainable developments and adapting legal measures for water use and utilization of Republic of Korea and Japan to modify in draft regulation of section 78 because both countries have experience and established legal measures similar to Thailand. Therefore, we propose Draft regulation on the basic of sustainable development of water resource using, protection of water pollutions and people and community participations on conservation and development of water resource. Legal measures of draft regulation under section 78 are concerned, the regulation provides the control of water use and utilization on water resources should be harmonized on the concept of sustainable development, legal measures to protect water pollution and water quality, providing the duty of water users who living at or around water resources to build up or setting equipment or using any measures for monitoring water quality under support of authority state governments. This regulation also provides the power of Director general of Water resource Department to make order to the owners of the building or director of any actions which may damage water resources to stop action or to destroy building and make order to giving their compensation. Finally, it provides other measures to protect water resources by appropriate order of Ministry of Natural Resources and Environment under section 78 (5) later. The draft notification under section 81 has set form of the water official identification card issued by Ministry of Natural resource and Environment. This has been designed in the same manner as others water official identification issued by other Ministers under Water Resource Act of B.E. 2561 in order to prevent the confusion of the people. Beyond above mentioned, this research has recommend what should water resources be responsible of Water Resource Department, best practices manual for implementation and cooperation on water resource acts, ranking of state officials who will be appointed to water resource officials under Water resource Act of B.E. 2561 and finally, measures and instrument for supporting public participations in water conservation and development program.
