การถอดบทเรียนการไกล่เกลี่ยข้อพิพาทในชุมชนเพื่อเสริมสร้างความเข้มแข็งของชุมชน

Abstract

กระบวนการไกล่เกลี่ยข้อพิพาทในชุมชน เป็นกิจกรรมทางสังคมในรูปแบบหนึ่งที่ส่งเสริมและสนับสนุนให้ชุมชนได้มีส่วนร่วมในการจัดการแก้ไขปัญหาความขัดแย้งภายในชุมชนด้วยความสมัครใจของคู่ขัดแย้ง และใช้กระบวนการยุติธรรมทางเลือก อันจะนำไปสู่การลดคดีเข้าสู่ชั้นศาล และลดภาระค่าใช้จ่ายของประชาชนอันเกิดจากการเข้าถึงจนออกจากกระบวนการยุติธรรมหลัก ในบทความนี้พยายามนำเสนอแนวทางและวิธีการพัฒนากระบวนการไกล่เกลี่ยข้อพิพาทตามบทบาทหน้าที่ของศูนย์ยุติธรรมชุมชนตัวอย่าง ๘๑ แห่งในสำนักงานยุติธรรมจังหวัด ๒๗ จังหวัดทั้งที่มีอัตราการไกล่เกลี่ยสำเร็จสูงสุด และต่ำสุดจากสถิติย้อนหลัง ๓ ปี (พ.ศ.๒๕๕๘-๒๕๖๐) เพื่อส่งเสริมสนับสนุนความเข้มแข็งให้ชุมชน โดยอาศัยข้อมูลภาคสนามจากการถอดบทเรียนภายใต้โครงการวิจัยการถอดบทเรียนการไกล่เกลี่ยข้อพิพาทในชุมชนเพื่อเสริมสร้างความเข้มแข็งของชุมชน

A community conflict conciliation process one form of social activity that supports, empowers, and encourages community to conciliate among conflict parties by their own accord through a restorative justice. This process not only helps decreasing number of cases filed into the court but also help reducing the cost that conflict parties have to bear from accessing the judiciary process. By sampling through 81 community justice centres in 27 provinces in Thailand, from the area with the highest conciliation rate to the lowest in the last three years (2015-2017), this article is an effort to exhibit models and guidelines to develop a conflict conciliation process for community.
