Abstract

1. บทนำ สถาบันวิจัยและให้คำปรึกษาแห่งมหาวิทยาลัยธรรมศาสตร์ ได้รับมอบหมายจากกรมกิจการเด็กและเยาวชน กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ ให้ดำเนิน “โครงการจัดทำแนวทางศึกษารูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก” ซึ่งมีเป้าหมายหลักในการสร้างกลไกการให้บริการการคุ้มครองเด็กในชุมชนที่มีประสิทธิภาพ ทั้งการติดตาม การรายงาน การช่วยเหลือเด็กที่อยู่ในสภาวะเสี่ยงหรือตกเป็นเหยื่อของการใช้ความรุนแรง การกระทำที่มิชอบ การแสวงหาประโยชน์ การละเลยทอดทิ้ง และปัญหาอื่น ๆ ภายใต้แนวคิดการมีส่วนร่วมของชุมชนในการพัฒนา ปกป้อง คุ้มครอง และช่วยเหลือเด็กในชุมชนของตนเองอย่างเป็นรูปธรรมและยั่งยืน การดำเนินโครงการวิจัยนี้ตั้งอยู่บนวัตถุประสงค์การศึกษา คือหนึ่งเพื่อศึกษาหาแนวทางหรือรูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก สองเพื่อให้ชุมชนมีส่วนร่วมในการพัฒนาและคุ้มครองเด็กในชุมชนแบบยั่งยืน และสามเพื่อพัฒนาองค์ความรู้หรือจัดทำองค์ความรู้ในการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก กลุ่มเป้าหมายในการศึกษา ประกอบด้วย ผู้บริหารและเจ้าหน้าที่จากองค์กรปกครองส่วนท้องถิ่นโรงพยาบาลส่งเสริมสุขภาพตำบล สถานศึกษา องค์กรพัฒนาเอกชน สถานีตำรวจภูธร ศูนย์พัฒนาครอบครัวในตำบล คณะกรรมการคุ้มครองเด็กระดับตำบล ผู้นำชุมชน อาสาสมัคร และผู้ปฏิบัติงานคุ้มครองเด็กในชุมชน ในพื้นที่ที่มีการดำเนินระบบการเฝ้าระวังและช่วยเหลือเด็ก (CPMS : Child Protection Monitoring System) พื้นที่ที่มีความเข้มแข็งซึ่งมีศูนย์พัฒนาครอบครัวดีเด่น/ศูนย์พัฒนาครอบครัวดี พื้นที่ที่มีการดำเนินงานพัฒนาคุณภาพชีวิตเด็กโดยชุมชน (Child life) จำนวน 36 พื้นที่ รวมไปถึงผู้แทนกรมกิจการเด็กและเยาวชน บ้านพักเด็กและครอบครัวจังหวัด ทีมสหวิชาชีพ และองค์การพัฒนาเอกชนที่เกี่ยวข้องภายใต้พื้นที่การศึกษาทั้งหมด 36 พื้นที่ ครอบคลุม 12 จังหวัด ได้แก่ เชียงใหม่ พะเยา ลำปาง กาญจนบุรี จันทบุรี นครปฐม อุดรธานี ร้อยเอ็ด สุรินทร์ ชุมพร พังงา และสตูล โครงการนี้มีขอบเขตระยะเวลาดำเนินการ 11 เดือน ระหว่ างเดือนพฤศจิกายน พ.ศ. 2557 ถึงเดือนกันยายน พ.ศ. 2558 โดยมีขอบเขตการศึกษา คือ 1) จัดทำกระบวนการศึกษาขั้นตอนการดำเนินงานเพื่อสังเคราะห์รูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก 2) ศึกษาวิจัยเอกสารและทบทวนวรรณกรรมเกี่ยวกับการคุ้มครองเด็กในชุมชน 3) เข้าร่วมสังเกตการณ์การจัดประชุมและการจัดกิจกรรมในพื้นที่ 4 เรื่อง ได้แก่ กิจกรรมการชี้แจงทำความเข้าใจร่วมกันเ กี่ยวกับโครงการเสริมสร้างชุมชนคุ้มครองเด็ก การพัฒนาศักยภาพคณะทำงานและคุ้มครองเด็กในชุมชน การจัดบริการสำหรับเด็กในพื้นที่ และการระดมทรัพยากรและผลักดันเข้าสู่แผนท้องถิ่น 4) ปฏิบัติหน้าที่เป็นที่ปรึกษาทางวิชาการเพื่อให้คำาแนะนำ/คำปรึกษา และดำเนินการเกี่ยวกับการดำเนินงานการเสริมสร้างความเข้มแข็งของชุมชนในการคุ้มครองเด็ก 5) จัดประชุมเชิงปฏิบัติการถอดบทเรียนผลการดำเนินงานการพัฒนาและคุ้มครองเด็กในชุมชน เพื่อสังเคราะห์รูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก โดยมีผู้เข้าร่วมประชุม ได้แก่ ผู้แทนองค์กรปกครองส่วนท้องถิ่น ผู้ปฏิบัติงานด้านเด็กในชุมชน ผู้ที่เกี่ยวข้องจาก 36 พื้นที่ เจ้าหน้าที่สำนักงานพัฒนาสังคมและความมั่นคงของมนุษย์ จังหวัด ทีมสหวิชาชีพ เจ้าหน้าที่ กรมกิจการเด็กและเยาวชน และวิทยากร ไม่น้อยกว่า 80 คน 6) จัดทำร่างรายงานการสังเคราะห์รูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก 7) จัดประชุมเพื่อรับฟังความคิดเห็นต่อร่างรายงานการสังเคราะห์รูปการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก โดยผู้เข้าร่วมประชุม ประกอบด้วย ผู้แทนองค์ฏรปกครองส่วนท้องถิ่น ผู้ปฏิบัติงานด้านเด็กในชุมชน ผู้ที่เกี่ยวข้อง เจ้าหน้าที่สำนักงานพัฒนาสังคมและความมั่นคงของมนุษย์จังหวัด เจ้าหน้าที่กรมกิจการเด็กและเยาวชน ทีมสหวิชาชีพ และวิทยากร รวมจำนวน 85 คน โดยมีผู้ทรงคุณวุฒินำอภิปรายผลการศึกษา 3 ท่าน ได้แก่ ดร. สีลาภรณ์ บัวสาย รองผู้อำนวยการสำนักงานกองทุนสนับสนุนการวิจัย ด้านยุทธศาสตร์ วิจัยเชิงพื้นที่ ในฐานะนักวิชาการ นางแจ่มจันทร์ เกียรติกุล พัฒนาสังคมและความมั่นคงของมนุษย์จังหวัดกาฬสินธุ์ ในฐานะข้าราชการที่ปฏิบัติงานเกี่ยวข้องโดยตรง และนายสมพงค์ สระแก้ว ผู้อำนวยการ และผู้ก่อตั้งมูลนิธิเครือข่ายส่งเสริมคุณภาพชีวิตแรงงาน ในฐานะตัวแทนองค์กรภาคประชาสังคม 2. ผลการศึกษาจากการสังเกตการณ์กิจรรมการพัฒนา ปกป้อง และคุ้มครองเด็กในชุมชน คณะผู้วิจัยได้เข้าร่วมสังเกตการณ์การดำเนินงานตามแผนการดำเนินงานด้านการพัฒนาและคุ้มครองเด็กในชุมชน จำนวน 26 พื้นที่ จากเป้าหมายทั้ง 36 พื้นที่ ใน 12 จังหวัด ทั่วทุกภูมิภาค และได้ศึกษาถึงข้อจำกัดในการขับเคลื่อนกิจกรรม รวมทั้งปัจจัยความสำเร็จในพื้นที่ที่ประสบความสำเร็จ จนนำไปสู่การสร้างแนวปฏิบัติของการดำเนินกิจกรรมในพื้นที่อื่น ๆ ต่อไปในอนาคตได้ดังนี้ 1. แนวปฏิบัติในการชี้แจงทำความเข้าใจแก่องค์กรภาคีในพื้นที่เป้าหมาย มุ่งเน้นให้ความสำคัญกับการคัดเลือกผู้ประสานงานระดับจังหวัด ซึ่งต้องมีคุณสมบัติที่เอื้อต่อกระบวนการทำงาน มีความเป็นผู้นำมีความน่าเชื่อถือ สามารถทำหน้าที่ ให้คำแนะนำให้คำปรึกษาทางเลือก เพื่อชี้ให้เห็นถึงจุดอ่อน จุดแข็งของทางเลือกต่าง ๆ ในการขับเคลื่อนกิจกรรมให้บรรลุเป้าหมาย 2. แนวปฏิบัติในการจัดกิจกรรมการพัฒนาศั กยภาพคณะทำงานพัฒนาและคุ้มครองเด็กในชุมชน เน้นสร้างความรู้ความเข้าใจเกี่ยวกับการทำงานคุ้มครองเด็กในชุ มชนให้กับคณะทำงานพัฒนาและคุ้มครองเด็กในชุมชน ทั้งความรู้ในเชิงวิชาการ และทักษะต่าง ๆ ที่จำเป็นสำหรับผู้ปฏิบัติงานคุ้มครองเด็ก 3. แนวปฏิบัติในการจัดกิจกรรมการบริการสำหรับเด็กในพื้นที่ คณะทำงานพัฒนาและคุ้มครองเด็กในชุมชน เป็นผู้ มีบทบาทหลักในการขับเคลื่อนกิจกรรม โดยมีผู้ประสานงานพื้นที่ทำหน้าที่ประสานงาน ให้คำปรึกษาแนะนำ เป็นพี่เลี้ยงเพื่อออกแบบกิจกรรมให้มีความสอดคล้องและสนองตอบต่อสถานการณ์ปัญหาด้านเด็กในพื้นที่ซึ่งแตกต่างกันออกไป 4. แนวปฏิบัติในการจัดกิจกรรมระดมทรัพยากรและผลักดันเข้าสู่แผนพัฒนาท้องถิ่น ผลลัพธ์ คือการจัดกิจกรรมการระดมทรัพยากร และผลักดันเข้าสู่แผนพัฒนาท้องถิ่นมีความคาดหวังต่อผลลัพธ์(Output) ที่ได้จากการทำกิจกรรมหลายประการด้วยกัน ได้แก่ (1) แหล่งทุนหรือช่ องทางในการแสวงหาทรัพยากร ซึ่งประกอบด้วย แหล่งทุนภายในพื้นที่ชุมชน ได้แก่ งบประมาณขององค์กรปกครองส่วนท้องถิ่นกองทุนต่าง ๆ ของชุมชน ปราชญ์ชาวบ้าน เครือข่ายอาสาสมัคร อาคารสถานที่ของหน่วยงานภายในชุมชน เป็นต้น และแหล่งทุนภายนอก และแหล่งทุนภายนอก ระดับจังหวัด ได้แก่ องค์การบริหารส่วนจังหวัด สมาชิกสภาผู้แทนราษฎรในพื้นที่องค์กรภาคประชาสังคมต่าง ๆ ส่วนราชการในพื้นที่ส่วนระดับชาติ ได้แก่ กรมกิจการเด็กและเยาวชน สำนักงานปลัดกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ สำนักงานกองทุนสนับสนุนการสร้างเสริมสุขภาพ ( สสส. ) สำนักงานหลักประกันสุขภาพแห่งชาติ (2) ลักษณะของทรัพยากรที่จะนำมาใช้ในการขับเคลื่อนกิจกรรมต่อไป ซึ่งคณะทำงานสามารถเลือกใช้ทรัพยากรที่มีอยู่ทั้งในและนอกชุมชนได้หลากหลายรูปแบบ ได้แก่ 1) ทรัพยากรมนุษย์หรือตัวบุคคล 2) ทรัพยากรในรูปแบบสถานที่ทำกิจกรรม 3) ทรัพยากรในรูปแบบสภาพแวดล้อมธรรมชาติหรือชุมชน 4) ทรัพยากรองค์ความรู้ ซึ่งอาจปรากฏอยู่ ในสื่อสารสนเทศหนังสือ เอกสาร หรือบุคคล หากคณะทำงานนำทรัพยากรที่ไม่ใช่ตัวเงิน นี้มาใช้ได้อย่างมีประสิทธิภาพจะสามารถช่วยประหยัดต้นทุนค่าใช้จ่ายทรัพยากรในรูปแบบตัวเงินและเสริมสร้างสำนึกที่ดีและเป็นการแสดงน้ำใจ ความเสียสละ และการร่วมไม้ร่วมมือของคณะทำงาน เครือข่าย และสมาชิกในชุมชน 3. รูปแบบการเสริมสร้างความเข้มแข็งของชุมชนคุ้มครองเด็ก ระบบการเสริมสร้างความเข้ มแข็งของชุมชนคุ้มครองเด็ก ประกอบด้วย กลไกการประสานความร่วมมือในแนวระนาบระหว่างตัวแสดงที่เกี่ยวข้องใน 3 ระดับ ได้แก่ กลไกการประสานความร่วมมือในระดับตำบล กลไกการประสานความร่วมมือในระดับจังหวัด และกลไกการประสานความร่วมมือในส่วนกลาง ซึ่งการทำงานของกลไกแต่ละระดับมีจุดมุ่งหมายเฉพาะในมิติที่แตกต่างกัน ซึ่งในอนาคตระบบการขับเคลื่อนโครงการเสริมสร้างความเข้มแข็งของชุ มชนคุ้มครองเด็กไปสู่การปฏิบัติให้ครอบคลุมพื้นที่ ตบลทั่วประเทศจะต้องดำเนินการใน 4 ขั้นตอนหลัก ได้แก่ ขั้นตอนการเกื้อหนุน เป็นบทบาทหลักของกรมกิจการเด็กและเยาวชนในการจัดทำกรอบแนวคิด คู่มือประสานงานกับส่วนราชการระดับกรมในส่วนกลางที่เกี่ยวข้องและมีส่วนราชการในระดับพื้นที่ ขั้นตอนการเตรียมการ กรมกิจการเด็กและเยาวชนประสานงานกับกลไกระดับจังหวัด ได้แก่ ผู้ว่าราชการจังหวัด คณะกรรมการคุ้มครองเด็กจังหวัด และคณะกรรมการบริหารงานจังหวั ดแบบบูรณาการ เพื่อรับทราบและร่วมกันขับเคลื่อนกิจกรรมในพื้นที่ ขั้นตอนการสร้างเครือข่าย องค์กรปกครองส่วนท้องถิ่นมีบทบาทหลักในการจับเคลื่อนการจัดทำข้อตกลงความร่วมมือในการพัฒนาและคุ้มครองเด็กในชุมชน และประสานงานกับองค์กรภาคี เพื่อจัดทำแผนปฏิบัติงานร่วมกัน ขั้นตอนการขับเคลื่อนกิจกรรม คณะทำงานพัฒนาและคุ้มครองเด็กในชุ มชน จะเป็นผู้ขับเคลื่อนกิจกรรมให้เป็นไปตามแผนงานเพื่อให้บรรลุข้อตกลงความร่วมมือ นอกจากกิจกรรมที่เน้นสร้างความรู้และทักษะเกี่ยวกับการคุ้มครองเด็กในชุ มชนแล้ว คณะทำงานดังกล่าวยังต้องมีการประชุมเพื่อประเมินผล ถอดบทเรียนและทบทวนแผนการดำเนินงานที่ผ่านมาทั้งหมด โดยพิจารณาเชื่อมโยงกับข้อมูลแนวโน้มสถานการณ์และกลุ่มเสี่ยงหรือประเด็นปัญหาในพื้นที่ เพื่อนำผลวิเคราะห์ดังกล่าวเป็นฐานในการกำหนดแผนงานและออกแบบกิจกรรมสำหรับผลักดันเข้าสู่กระบวนการจัดสรรงบประมาณของหน่วยงานและองค์กรภาคี ตลอดจนระดมทรัพยากรจากแหล่งต่าง ๆ สำหรับขับเคลื่อนการดำเนินงานในรอบปีงบประมาณต่อไป 1. Introduction Thammasat University Research and Consultancy Institute has been assigned by Department of Children and Youth, Ministry of Social Development and Human Security to implement the project on “Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level.” This project aims to establish effective mechanisms for child protection practices at the community level. The child protection practices involve follow-ups, reports, assisting children who are at risk from or become victims of violence, exploitation, abuse, neglect, abandonment and other problems and are implemented in compliance with the concept of community participation in development, protection and assisting children in the community with tangibility and sustainability. The objectives of this project are 1) to examine guidelines or models of strengthening child protection in the community, 2) to encourage community participation on sustainably developing and protecting children in the community and 3) to increase or to establish knowledge of strengthening child protection in the community. The focus groups of this study are the executives and officers from Local Administrative Organizations, Sub-District Health Promoting Hospitals, schools, Private Development Organization, police stations, Family Development Center in Sub-District, SubDistrict Committee on Child Protection, community leaders, volunteers and child protection officers in the communities under the Child Protection Monitoring System (CPMS), in the strong communities with Excellent and Good Family Development Centers and in the community under the CHILDLIFE project, making a total of 36 areas. The focus groups also include representatives of Department of Children and Youth, Provincial Shelter for Children and Families, Multidisciplinary team and private organizations concerned in the total of 36 areas covering 12 provinces, including Chiang Mai, Phayao, Lampang, Kanchanaburi, Chantaburi, Nakhon Pathom, Udon Thani, Roi Et, Surin, Chumphon, Phangnga and Satun. The duration of this project was 11 months, from November 2014 to September 2015. The scope of research is 1) To develop a process of synthesizing Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level 2) To study data and review literature concerning child protection at the community level 3) To observe meetings and activities in the areas concerning 4 issues: activities on promoting mutual understanding of Child Protection Strengthening Project, on increasing capacity of Child Protection and Working Group, on working practices in the community and on resource mobilization and proposing to Local Development Plan 4) To act as the academic advisor in order to give advice/suggestion and to implement the Child Protection Strengthening approach 5) To hold workshop on the outcomes of child development and protection in the community to synthesize the Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level and the attendees, at least 80 people, include representatives from Local Administrative Organizations, child services operators, others concerned from 36 areas, officers from Provincial Social Development and Human Security Office, Multidisciplinary team, officers from Department of Children and Youth and experts. 6) To draft a report of synthesizing Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level 7) To hold the meeting to receive feedbacks on the report of synthesizing Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level and the 85 attendees included representatives from Local Administrative Organizations, child services operators, others concerned, officers from Provincial Social Development and Human Security Office, Multidisciplinary team, officers from Department of Children and Youth and experts. The qualified persons who leaded the discussion on the outcomes were Dr. Silaporn Buasai, Deputy Director for Area Strategy, as an academic, Mrs.Jamjan Kiarttikul, Provincial Social Development and Human Security officer, as an active officer, and Mr. Sompong Sakaew, a founder of Labour Rights Promotion Network Foundation, as representative of civil society organization. 2. The results of the observation on child development and protection activities at the community level The researchers observed the operations according to the child development and protection plan in the community of 26 areas from a total of 36 areas in 12 provinces and examined limitations on implementing activities and contributing factors in the successful areas which leaded to the following guidelines for other areas: 1. Guidelines on providing clarification to the partner organizations in the target area focus on selecting the provincial coordinators whose qualifications should facilitate the working process. They are required to possess leadership and reliability qualities and be able to give advice and suggestion on indicating strengths and weaknesses on different options for achieving activities. 2. Guidelines on arranging the activities on increasing the capacity of Child Development and Protection at the Community Level Working Group focus on establishing academic knowledge and necessary skills about working practices for child protection at the community level for the Child Development and Protection at the Community Level Working Group. 3. Guidelines on arranging the activities on child services in the target area The Working Group takes a major role in arranging the activities and the coordinators coordinate, give advice or suggestion, and provide mentoring to design the activities responsive to varied child problems in the area. 4. Guidelines on arranging the activities on resource mobilization and proposing to Local Development Plan The output is arranging the activities on resource mobilization and proposing to Local Development Plan and includes: (1) funding sources or acquiring resources approaches which consist of funding sources in the community including Local Government budget, funds of the community, local intellectuals, Volunteer Association, public buildings in the community etc. and external resources, external resources at the provincial level include Provincial Administrative Organization, local Members of Parliament, civil society organizations, local government offices, and national agencies, which are Department of Children and Youth, Office of the Permanent Secretary of the Ministry of Social Development and Human Security, Thai Health Promotion Foundation (ThaiHealth) and National Health Security Office (2) characteristics of resources for further activities provided for the Working Group including 1) human or personnel resources 2) location resources 3) environmental or community resources 4) knowledge resources on information, books, documents, or human and if the working group uses these non-financial resources effectively, this will secure a budget for financial resources and raise public consciousness and share generosity, sacrifice and cooperation among the working group, the networks and community members. 3. Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level The Developing Models and Working Practices for Child Protection Monitoring System (CPMS) at the Community Level consist of mechanisms for horizontal cooperation between agencies in three levels: mechanisms for Sub-District cooperation, mechanisms for Provincial cooperation and mechanisms for Central cooperation. The working mechanism of each level has a specific purpose. From now on, this project will be implemented in all subdistrict Areas in the following 4 stages: Advocating Stage: a main role of the Department of Children and Youth in providing conceptual frameworks and handbooks and coordinating with central and local agencies. Preparing Stage: Department of Children and Youth coordinates with the provincial agencies, including Governors, Provincial Child Protection Committee and Integrated Provincial Administrative Committee in order to acknowledge and cooperate on activities in the area. Networking Stage: Local Administrative Organizations have a vital role in arranging the agreement on Child Development and Protection at the Community Level and cooperating with the partner organizations to prepare operational plans. Activity Implementation Stage: Child Development and Protection Working Group will implement activities according to the operation plan in order to reach the agreement. Apart from the activities focusing on establishing knowledge and skills about child in the community, the Working Group is also obliged to hold meeting on evaluation, lesson learned, and review the implemented operational plans by connecting with data about trends and vulnerable group or issues in the area. The analysis results will be applied to determine operational plans and design activities for proposing to budgeting process of agencies and partner organizations, along with resources mobilization from various sources for the operation in the next fiscal year.
