ศึกษาหลักเกณฑ์การส่งเสริมและคุ้มครองสิทธิของคนพิการและคนด้อยโอกาสให้เข้าถึงหรือรับรู้และใช้ประโยชน์จากรายการของกิจการกระจายเสียงและกิจการโทรทัศน์

Abstract

โครงการศึกษาหลักเกณฑ์การส่งเสริมและคุ้มครองสิทธิของคนพิการและคนด้อยโอกาสให้เข้าถึงหรือรับรู้และใช้ประโยชน์จากรายการของกิจการกระจายเสียงและกิจการโทรทัศน์ มีวัตถุประสงค์ในการศึกษา คือ ๑. เพื่อศึกษาหลักเกณฑ์การส่งเสริมและคุ้มครองสิทธิของคนพิการและคนด้อยโอกาสให้เข้าถึงหรือรับรู้และใช้ประโยชน์จากรายการของกิจการกระจายเสียงและกิจการโทรทัศน์ ๒. เพื่อให้สำนักงาน กสทช. มีข้อมูลประกอบการจัดทำข้อเสนอต่อ กสทช. ในการส่งเสริมและคุ้มครองสิทธิของคนพิการ สามารถเข้าถึงข้อมูลข่าวสารผ่านกิจการกระจายเสียงและกิจการโทรทัศน์ได้อย่างเสมอภาคกับบุคคลทั่วไป คณะวิจัยศึกษาข้อมูลทุติยภูมิ ๕ ด้าน คือ ๑) การศึกษาข้อมูลที่เกี่ยวข้องกับคนพิการ คนด้อยโอกาส ประกาศ พระราชบัญญัติ มาตรการ ระเบียบ และอื่น ๆ ที่เกี่ยวข้องในประเทศไทย ๒) งานวิจัยที่เกี่ยวข้องในประเทศไทย ๓) ข้อมูลที่เกี่ยวข้องที่มีผลต่อหลักเกณฑ์การส่งเสริมและคุ้มครองสิทธิของคนพิการและคนด้อยโอกาสให้เข้าถึงหรือรับรู้และใช้ประโยชน์จากรายการของกิจการกระจายเสียงและกิจการโทรทัศน์ ๔) ข้อมูลที่เกี่ยวข้องจากต่างประเทศ และ ๕) ผลการศึกษาและข้อเสนอแนะเชิงนโยบาย ๕) ผลการศึกษาและข้อเสนอแนะเชิงนโยบาย ผลการศึกษาแบ่งเป็น ๒ ด้าน ได้แก่ ผู้ประกอบกิจการโทรทัศน์ สถาบันการศึกษา และคนพิการหูหนวกและตาบอด ๕.๑ ผลการศึกษา - ผู้ประกอบกิจการโทรทัศน์ เสนอว่าเบื้องต้นควรมีการแก้ไขพระราชบัญญัติการประกอบกิจการกระจายเสียงและกิจการโทรทัศน์ พ.ศ. ๒๕๖๑ เพื่อกำหนดประเภทรายการ การจัดสัดส่วนให้สอดคล้องกับใบอนุญาตที่ผู้ประกอบการฯ ได้รับ หากดำเนินการไปโดยไม่สอดคล้องกับพระราชบัญญัติฯ จะมีผลกระทบตามภายหลัง มาตรการส่งเสริมด้านอุปกรณ์ เพื่อให้ผู้ประกอบกิจการโทรทัศน์มีอุปกรณ์ในการผลิต การส่งเสริมเงินสนับสนุนการผลิตรายการ การกำกับดูแล การประเมินการให้บริการ จากคู่มือที่ได้จัดทำร่วมกับสมาคมคนพิการที่เกี่ยวข้องในการผลิตรายการแล้ว ผู้ประกอบกิจการฯ ได้เสนอให้ กสทช. เป็นผู้ดำเนินการจัดรับฟังความคิดเห็นโดยให้คนพิการรับชมรายการที่มีการให้บริการ เพื่อให้ได้ข้อเสนอแนะมาปรับปรุงการผลิตรายการให้เหมาะสมและการส่งเสริมการมีส่วนร่วมของคนพิการ แม้ว่าผลงานวิจัยจากสถาบันการศึกษาจะพบว่าหากได้นำคนพิการเข้ามาร่วมผลิตรายการ จะทำให้การผลิตรายการเป็นไปตามมาตรฐานและสอดคล้องกับความต้องการของคนพิการ ได้รับการลดหย่อนภาษี แต่ในทางปฏิบัติแล้ว ต้องพิจารณาด้านการจัดกายภาพของสถานีโทรทัศน์ การจัดให้มีบุคลากรที่สามารถสื่อสารภาษามือได้ ซึ่งถือเป็นการเตรียมความพร้อมที่จะให้คนพิการเข้ามาเป็นส่วนหนึ่งในทีมงานผลิตรายการ - คนพิการหูหนวกและตาบอด มีข้อเสนอแนะให้มีการให้บริการทั้ง ๓ ด้านในประเภทรายการที่หลากหลาย ไม่ควรจำกัดสิทธิการเข้าถึงเฉพาะรายการที่กำหนดใน พรบ. เท่านั้น การกำหนดสัดส่วน คนตาบอดต้องการให้กำหนดเป็นชั่วโมงต่อวันหรือต่อสัปดาห์หรือต่อเดือน คนพิการหูหนวกแสดงความคิดเห็นว่าไม่ควรกำหนดสัดส่วน เนื่องจากสถานีโทรทัศน์ขอผ่อนผันมาระยะหนึ่งแล้ว ด้านการกำกับดูแล ควรมีการประเมินคุณภาพรายการที่จัดบริการให้คนพิการโดยให้ กสทช. เป็นผู้ดำเนินการ เพื่อนำส่งให้สถานีโทรทัศน์ฯ ได้รับทราบแนวทางการปรับปรุง แก้ไข พัฒนาการให้บริการ สำหรับคนหูหนวกให้ความสำคัญกับคุณภาพล่ามภาษามือที่ยังไม่ได้มาตรฐาน นำเสนอเนื้อหาไม่ครบ และเนื้อหาไม่ถูกต้อง ด้านเกณฑ์ กลไกที่จำเป็นและเหมาะสม คือ การผลักดันให้มีงานวิจัยเพื่อพัฒนาองค์ความรู้ ถอดบทเรียนการให้สามารถนำไปใช้ประโยชน์ ภายใต้เกณฑ์ที่ถูกต้องและชัดเจนตามคู่มือและแนวทางที่ได้กำหนด The criteria of the promoting and protecting rights of disabled and disadvantaged people to access, or have awareness, and gain benefits from broadcasting and television businesses’ programs study project have research objectives which are 1) to study the criteria of the promoting and protecting rights of disabled people and ones who are disadvantaged to access, or have awareness, and gain benefits from the use of broadcasting and television businesses’ programs, 2) to provide Office of the NBTC with information using to make offer to NBTC in promoting and protecting rights of disabled people and ones who are disadvantaged to be able to access to news information equally comparing to general public. The researchers studied secondary sources comprising of 5 topics which are 1) the study of related information about disabled people, disadvantaged people, related proclamations, acts, measures, regulations, and others in Thailand, 2) related researches in Thailand, 3) related information which has an effect on the promoting and protecting rights of disabled and disadvantaged people to access, or have awareness, and gain benefits from broadcasting and television businesses’ programs, 4) related abroad information, and 5) the result of the study and policy recommendations. 5) The result of the study comprises of 2 sections which are entrepreneurs in the television businesses, academic institutes, and disabled people who are deaf and blind. 5.1 The result of the study - Entrepreneurs in the television businesses proposed that there should be the amendment of the Broadcasting and Television Businesses Act B.E. 2561 in order to prescribe genres of television programs and organize a proportion consistently with received licensees. If television programs are not consistent with the Act, it will have a consequence. The measure tools supports also make entrepreneurs have tools used in the production. Financial supports for productions, the regulatory, and the service evaluation should be provided. According to the manual created by entrepreneurs together with related association of the physically handicapped in programs production, entrepreneurs purposed that NTBC will be a moderator who manages programs viewing by disabled people to listen to comments in order to receive recommendations for improving the programs appropriately, and promote disabled people’s participations. Although researches from academic institutes found that the disabled people’s participations in the programs can standardize, as well as be consistent with, the need of disabled people, receiving tax deduction, the physical environment of television and preparing a personnel who can use a sign language, in a practical way, need to be considered; it enhance readiness for disabled people to participate in the production teams. - Deaf and blind people purposed that there should be 3 services types in various kinds of programs. The rights to access should not be restricted for only specific programs prescribed in the acts. About the proportion setting, blind people want to restrict the proportion as the number of hours per day/or week/or month. However, Deaf people do not agree with the proportion restriction because television stations have asked for indulgence for a while. About the regulatory, quality of programs for disabled people should be evaluated; NTBC is a moderator. The purpose is to improve, fix, and develop the programs for deaf people. It is important for the program to consider on sign language interpreters about the low standard, informing uncovered contents, and informing wrong contents. About the regulation, providing support for doing research is the suitable necessary mechanism. The lesson can be applied to be used under the right and clear criteria following the manual and regulated ways.
