มาตรา 144 ของรัฐธรรมนญแห่งราชอาณาจักรไทย พุทธศักราช 2560 ได้กำหนดห้ามมิให้สมาชิกสภาผู้แทนราษฎรแปรญัตติเปลี่ยนแปลงหรือแก้ไขเพิ่มเติมรายการหรือจำนวนในรายการ ในร่างกฎหมายว่าด้วยงบประมาณรายจ่าย และห้ามมิให้มีการเสนอการแปรญัตติหรือการกระทำด้วยประการใด ๆ ที่มีผลให้สมาชิกสภาผู้แทนราษฎร สมาชิกวุฒิสภา หรือกรรมาธิการวิสามัญที่พิจารณาร่างกฎหมายว่าด้วยงบประมาณรายจ่ายมีส่วนไม่ว่าโดยทางตรงหรือโดยทางอ้อมในการใช้งบประมาณรายจ่าย รวมทั้งได้กำหนดมาตรการในการลงโทษผู้ฝ่าฝืนบทบัญญัติ และมาตรการในการเยียวยาความเสียหายแก่รัฐไว้ด้วย โดยให้ศาลรัฐธรรมนูญเป็นผู้พิจารณาวินิจฉัยประเด็นข้างต้น บทบัญญัติดังกล่าวก่อให้เกิดประเด็นปัญหาทางกฎหมายที่สำคัญไม่ว่าจะเป็นปัญหาการตีความ “การกระทำด้วยประการใด ๆ ที่มีผลให้สมาชิกสภาผู้แทนราษฎร สมาชิกวุฒิสภาหรือกรรมาธิการมีส่วนไม่ว่าโดยทางตรงหรือทางอ้อมในการใช้งบประมาณรายจ่าย” ปัญหาการปรับใช้บทบัญญัติที่เกี่ยวข้องกับมาตรการลงโทษ และมาตรการเยียวยาความเสียหายแก่รัฐ รวมทั้งปัญหาอำนาจในการพิจารณาวินิจฉัยของศาลรัฐธรรมนูญในกรณีที่คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติเป็นผู้เสนอความเห็นต่อศาลรัฐธรรมนูญ งานวิจัยนี้จึงได้ศึกษาหลักกฎหมายทั่วไปของกฎหมายมหาชน หลักกฎหมายเฉพาะของกฎหมายการคลัง และกฎหมายที่เกี่ยวข้องของต่างประเทศ ได้แก่ กฎหมายของประเทศอังกฤษ ฝรั่งเศส ตูนิเซีย และโปรตุเกส จากการศึกษาพบว่าไม่มีการกำหนดข้อห้ามมิให้มีการเสนอการแปรญัตติหรือการกระทำด้วยประการใด ๆ ที่มีผลให้สมาชิกสภาผู้แทนราษฎร สมาชิกวุฒิสภา หรือกรรมาธิการมีส่วนไม่ว่าโดยทางตรงหรือโดยทางอ้อมในการใช้งบประมาณรายจ่าย ตลอดจนมาตรการลงโทษ และมาตรการเยียวยาความเสียหายแก่รัฐในกฎหมายของต่างประเทศที่เลือกศึกษา แต่จากการพิจารณาหลักกฎหมายทั่วไปของกฎหมายมหาชนและหลักกฎหมายเฉพาะของกฎหมายการคลังจึงเสนอให้การตีความการกระทำด้วยประการใด ๆ มีผลให้สมาชิกสภาผู้แทนราษฎร สมาชิกวุฒิสภา หรือกรรมาธิการมีส่วนไม่ว่าโดยทางตรงหรือโดยทางอ้อมในการใช้งบประมาณรายจ่ายจะต้องพิจารณาหลักการแบ่งแยกอำนาจและหลักการขัดกันแห่งผลประโยชน์ การปรับใช้บทบัญญัติเกี่ยวข้องกับมาตรการลงโทษและมาตรการเยียวยาความเสียหายแก่รัฐจะต้องปรับใช้อย่างเคร่งครัดเพื่อป้องกันไม่ให้กระทบสิทธิและเสรีภาพของบุคคลเกินสมควรแก่เหตุ และศาลรัฐธรรมนูญไม่สามารถดำเนินการพิจารณาวินิจฉัยการแปรญัตติเปลี่ยนแปลงหรือแก้ไขเพิ่มเติมรายการหรือจำนวนในรายการในร่างกฎหมายว่าด้วยงบประมาณรายจ่ายที่คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งเป็นผู้เสนอความเห็นต่อศาลรัฐธรรมนูญได้ เนื่องจากปัญหาความลักลั่นของบทบัญญัติ มาตรา 144 ทั้งนี้ จึงได้เสนอให้มี การแก้ไขเพิ่มเติมบทบัญญัติมาตรา 144 ของรัฐธรรมนูญฉบับปัจจุบัน โดยกลับไปใช้หลักการตามมาตรา 180 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 และมาตรา 168 ของรัฐธรรมนูญแห่งราชอาณาจักรไทยพุทธศักราช 2550 ซึ่งเป็นแนวทางการแก้ไขปัญหาที่เหมาะสมสุด Section 144 of the Constitution of the Kingdom of Thailand, B.E. 2560 (2017) prohibits members of the House of Representative to motion to alter or add item or amount in an item to the appropriations bill. It also forbids any proposal, submission of a motion, or commission of any act, which may result in a direct or indirect involvement by members of the House of Representatives, senators or members of the ad hoc committee on studying appropriations bill in the use of the public expenditure. Section 144 further specifies sanctions against those who have violated the law and remedies for the State. The Constitutional Court has a competent jurisdiction to rule on these foregoing matters. This provision raises critical legal concerns, notably the interpretation of the phrase “commission of any act, which may result in a direct or indirect involvement by members of the House of Representatives, senators or members of the committee in the use of public expenditures”. It also leads to problems in the application of sanctions and the remedies, as well as the competence of the Constitutional Court over cases where the Nation Anti-Corruption Commission submits its opinion to the Court. This research, as a result, studies the general principles of public law, specific principles of public finance law and relevant laws of foreign countries, namely the United Kingdom, France, Tunisia and Portugal. According to the study, none of the selected foreign laws establishes the prohibition of any proposal, submission of a motion, or commission of any act, which may result in a direct or indirect involvement by members of the House of Representatives, senators or members of the ad hoc committee on studying appropriations bill in the use of public expenditures, including sanctions and remedial measures. However, based on the general principles of public law and specific principle of public finance law, the research team proposes that the interpretation of any commission of any act, which may result in a direct or indirect involvement by members of the House of Representatives, senators or members of the ad hoc committee on studying appropriations bill in the use of public expenditures, must adhere to the principle of separation of powers and the principle of conflict of interest. To avoid undue interference with an individual’s rights and liberties, the sanctions and the remedial measures must be strictly applied. Moreover, due to an incoherence of the provision under section 144, the Constitutional Court cannot adjudicate the case of a motion to alter or add item or amount in an item to the appropriations bill, which is brought to the Court by the National Anti-Corruption Commission. This research, therefore, recommends amending section 144 of the present Constitution by prescribing the same principle as those enshrined in section 180 of the Constitution of the Kingdom of Thailand, B.E. 2540 (1997) and section 168 the Constitution of the Kingdom of Thailand, B.E. 2550 (2007), which is seen as the most suitable solution. |
