พัฒนาปรับปรุงกฎระเบียบและกฎหมายที่เกี่ยวข้องว่าด้วยการอนุรักษ์พลังงาน

Abstract

โครงการนี้มีวัตถุประสงค์เพื่อปรับปรุงกฎหมายว่าด้วยการพัฒนาและส่งเสริมพลังงานและการส่งเสริมการอนุรักษ์พลังงานให้ทันสมัย สามารถใช้ส่งเสริมและกำกับดูแลในทางปฏิบัติได้อย่างเป็นรูปธรรม จัดทำร่างกฎหมายว่าด้วยการพัฒนาและส่งเสริมพลังงานและการส่งเสริมการอนุรักษ์พลังงาน เช่น พระราชบัญญัติ พระราชกฤษฎีกา กฎกระทรวงประกาศกระทรวง ประกาศกรม และเพื่อศึกษาความเหมาะสมในการกำหนดและการบังคับใช้พลังงานเพิ่มเติม ดำเนินงานศึกษาและวิเคราะห์ผลการดำเนินการตามกฎหมาย ปัญหาอุปสรรคจากการดำเนินการ ข้อจำกัดและความไม่ชัดเจนของกฎหมาย ศึกษาและวิเคราะห์กฎหมาย ระเบียน ข้อกำหนด แนวทางการกำกับดูแลการบังคับใช้ รวมถึงปัญหาอุปสรรคในการกำกับดูแลตามกฎหมายทั้งในและต่างประเทศ ศึกษาความเหมาะสมในการกำหนด การกำกับดูแลตามกฎหมาย ศึกษาและวิเคราะห์ความเหมาะสม แนวทางการบังคับใช้บทลงโทษ เงื่อนไขค่าธรรมเนียมพิเศษ และการส่งเสริมการอนุรักษ์พลังงาน ศึกษาและวิเคราะห์ความเหมาะสมในการกำหนดและบังคับใช้พลังงานควบคุม ศึกษาและวิเคราะห์กฎหมาย ระเบียบ ข้อกำหนดต่าง ๆ เกี่ยวกับการปรับเปลี่ยนวิธีการจัดส่งรายงาน การยื่นวินิจฉัย คำขอต่าง ๆ และการแจ้ง จากเอกสารต้นฉบับเป็นระบบอิเล็กทรอนิกส์ การนำผลการศึกษาที่ได้มาปรับปรุง พระราชบัญญัติการส่งเสริมการอนุรักษ์พลังงาน พ.ศ.2535 และพระราชบัญญัติการพัฒนาและส่งเสริมพลังงาน พ.ศ.2535 ดำเนินการจัดสัมมนาเพื่อระดมความคิดเห็นในเขตกรุงเทพมหานคร ปริมณฑล และส่วนภูมิภาค จำนวนทั้งสิ้น 7 ครั้ง มีผู้เข้าร่วมสัมมนาจำนวนทั้งสิ้น 1,106 คน นำผลสรุปจากการจัดสัมมนามาปรับแก้ไขร่างการปรับปรุงกฎหมายที่เกี่ยวข้องทั้งหมดและนำเสนอผลสรุปร่างกฎหมาย จัดทำคู่มือแนวทางการดำเนินงานตามกฎหมาย จำนวน 1,000 เล่ม และจัดสัมมนาเผยแพร่และสรุปผลการดำเนินงานโครงการในเขตกรุงเทพมหานคร ปริมณฑลและส่วนภูมิภาค จำนวน 4 ครั้ง มีผู้เข้าร่วมสัมมนาจำนวนทั้งสิ้น 775 คน The purpose of this project is to improve the law on energy development and promotion and modernization of energy conservation. It can be used to promote and supervise in practice. We prepared a draft law on energy development and promotion and promotion of energy conservation such as the Act Royal Decree, Ministerial Regulations, Ministry Announcements, Department Announcements, and study of the suitability of additional energy formulation and enforcement. We have conducted a study and analysis of legal actions, problems, obstacles from implementation, limitations and unclear laws. Then, we have studied and analyzed the law, records, requirements, regulatory guidelines, enforcement, as well as the problems and obstacles in the regulatory process both at home and abroad. We have analyzed the suitability of the regulatory formulation, enforcement guidelines, penalties, conditions, special fees, and energy conservation promotion, the determination and enforcement of controlled energy, and the modification of delivery methods of sending original documents into electronic systems. After that, we brought the results of the study to improve the Energy Conservation Promotion Act 1992 and the Energy Development and Promotion Act 1992. There were 7 seminars organized to brainstorm ideas in the Bangkok metropolitan region and provincial areas, with a total of 1,106 participants. We have summarized the results from the seminar to revise the draft amendments to all relevant laws and present the summary of the draft law, make a guide for the operation of the law in the amount of 1,000 books, and organize a seminar to disseminate and summarize the project operation results in Bangkok Metropolitan and provincial areas, 4 times, with a total of 775 participants
