ร่างกฎหมายลำดับรอง (เฉพาะมาตราเร่งด่วน)

Abstract

โครงการวิจัยนี้มีวัตถุประสงค์เพื่อจัดทำกฎหมายลำดับรองเพื่ออนุวัตน์ให้เป็นไปตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 จำนวน 13 มาตรา และแบบของประกาศ ระเบียบหรือข้อบัญญัติ และหลักเกณฑ์ วิธีการ จำนวน 5 มาตรา (รวม 18 มาตรา) ที่ออกตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 สามารถนำไปใช้บังคับได้อย่างมีประสิทธิภาพ ประสิทธิผล และได้รับการยอมรับจากทุกภาคส่วนที่เกี่ยวข้องและจัดทำต้นแบบคู่มือการปฏิบัติตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ.2561 สำหรับให้พนักงานเจ้าหน้าที่และประชาชนสามารถเข้าใจได้โดยง่าย ไม่ยุ่งยาก และผู้ที่เกี่ยวข้องนำไปปฏิบัติได้ รวมทั้งให้มีต้นแบบเอกสารและอุปกรณ์แสดงภาพม้วนเก็บ สำหรับเผยแพร่กฎหมาย วิธีการดำเนินการ ศึกษาเอกสาร รายงานการประชุมของกรรมาธิการสภานิติบัญญัติแห่งชาติ กฎหมายไทยและกฎหมายต่างประเทศ ได้แก่ สหราชอาณาจักร ออสเตรเลีย จัดประชุมรับฟังความเห็นจากผู้ที่เกี่ยวข้องทั้งภาครัฐและภาคเอกชน คณะกรรมการลุ่มน้ำ องค์กรผู้ใช้น้ำ จำนวน 2 ครั้ง แล้วนำมายกร่างกฎหมายลำดับรอง และรับฟังความเห็นระดับชาติอีกหนึ่งครั้ง แล้วนำข้อเสนอแนะมาปรับปรุงกฎหมายลำดับรอง รวมถึงจัดทำต้นแบบคู่มือการปฏิบัติตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 ผลการดำเนินงาน : 1. ร่างกฎหมายลำดับรอง จำนวน 13 มาตรา และแบบของประกาศ ระเบียบหรือข้อบัญญัติ และหลักเกณฑ์ วิธีการ จำนวน 5 มาตรา (รวม 18 มาตรา) ที่ต้องออกตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561 2. มีต้นแบบคู่มือการปฏิบัติตามพระราชบัญญัติทรัพยากรน้ำ พ.ศ. 2561. และกฎหมายลำดับรอง จำนวน 13 มาตรา และแบบของประกาศ ระเบียบหรือข้อบัญญัติ และหลักเกณฑ์ วิธีการ จำนวน 5 มาตรา (รวม 18 มาตรา) และต้นแบบเอกสารและอุปกรณ์แสดงภาพม้วนเก็บ (Roll up) สำหรับเผยแพร่กฎหมาย This research aims to develop and drafting regulations for implementation of 13 sections and drafting rules and notification of 5 sections (18 sections) under Water Act B.E. 2561 whichhave been implemented efficiency, effectiveness and have been agreed from all partnership; to develop model of guideline for the officials to implement regulations and rule mentioned aboved which contains clear information and easily to follow up; to develop model of chat and roll up of Water Act B.E. 2561 for dissemination. Methodology: documentary research on laws and regulations, minites of Paliament on 2 Water Law bill, textbooks both Thai and foreign law: United Kingdom and Australia organised meeting with relating persons both public and private sector, academics, experts and others stakeholders such as committee of water basin and water user organization for public hearing and recommendation to develop and draft regulations ,rule and notifications. In addition, organized public hearing on Draft regulation, rule and notifications under 18 sections of Water Act of B.E. 2561 and develop them in the final draft. The result of this research are as follows; 1. Draft regulation, rule and notification of 18 sections of Water Act of B.E.2561 2. A model of guideline for the officials to implement regulations and rule of 18 sections of Water Act of B.E.2561 3. A model of chat and roll up of Water Act B..E. 2561 for dissemination
