ศึกษาแนวทางหรือรูปแบบที่เหมาะสมในการเก็บค่าพิจารณารายงานการประเมินผลกระทบสิ่งแวดล้อม (IEE EIA และ EHIA) ตามหลักเจ้าของโครงการเป็นผู้รับผิดชอบค่าใช้จ่าย (Cost Recovery Method)

Abstract

เนื่องด้วยแผนการปฏิรูปประเทศ ด้านทรัพยากรธรรมชาติและสิ่งแวดล้อม เรื่อง ระบบบริหารจัดการ ทรัพยากรธรรมชาติและสิ่งแวดล้อม เสนอให้ “เพิ่มค่าตอบแทนการพิจารณารายงาน ค่าเดินทางลงพื้นที่ศึกษา โดยเก็บเป็นเงินค่าธรรมเนียมจากเจ้าของโครงการตามหลักผู้ได้ประโยชน์เป็นผู้จ่าย (Beneficiary Pay Principle: BPP)” กองพัฒนาระบบการวิเคราะห์ผลกระทบสิ่งแวดล้อม สำนักงานนโยบายและแผน ทรัพยากรธรรมชาติและสิ่งแวดล้อม (สผ.) จึงได้จัดทำการศึกษานี้ขึ้น โดยมีวัตถุประสงค์เพื่อหาแนวทางหรือ รูปแบบที่เหมาะสมในการเก็บค่าพิจารณารายงานการประเมินผลกระทบสิ่งแวดล้อม (IEE EIA และ EHIA) ตาม หลักการของเจ้าของโครงการเป็นผู้รับผิดชอบค่าใช้จ่าย (Cost Recovery Method) ที่เป็นไปตามแนวทางของ ผู้ได้รับประโยชน์เป็นผู้จ่าย (Beneficiary Pay Principle) และส่งเสริมการใช้งบประมาณอย่างมีประสิทธิภาพ และเกิดประสิทธิผลมากที่สุด การศึกษาใช้วิธีการทบทวนเอกสารเกี่ยวกับการดำเนินการรับรองรายงานการประเมินด้านสิ่งแวดล้อม หรือการรับรองมาตรฐานผลิตภัณฑ์ หรืออื่น ๆ ทั้งในและต่างประเทศ ประกอบกับการสัมภาษณ์เชิงลึก ผู้เชี่ยวชาญจากหน่วยงานรัฐและเอกชนที่เกี่ยวข้อง เพื่อวิเคราะห์และเสนอรูปแบบการเก็บค่าพิจารณารายงาน การประเมินผลกระทบสิ่งแวดล้อมที่เหมาะสม ผลการศึกษาในครั้งนี้เสนอแนะให้มีการจัดเก็บค่าพิจารณารายงานการประเมินผลกระทบสิ่งแวดล้อม โดยมีหลักการเก็บ คือ เก็บค่าพิจารณารายงานฯ จากเจ้าของโครงการ โดยให้ครอบคลุมค่าใช้จ่ายที่เกี่ยวข้อง กับการพิจารณารายงานฯ บางรายการ ได้แก่ (ก) ค่าใช้จ่ายเพื่อการประชุมพิจารณารายงานฯ และ (ข) ค่าใช้จ่ายในการลงพื้นที่สำรวจโครงการ ของคณะกรรมการผู้ชำนาญการพิจารณารายงานผลกระทบ สิ่งแวดล้อม (คชก.) และเจ้าหน้าที่ สผ. โดยมีรายละเอียดเพิ่มเติม เช่น ต้องครอบคลุมค่าใช้จ่ายในการประชุม พิจารณารายงานฯ จำนวนอย่างน้อย 3 ครั้ง คิดค่าใช้จ่ายในการลงพื้นที่ฯ แยกตามระยะทางที่ตั้งของโครงการ เป็นต้น According to the natural resources and environment section in the National Reform Plan, it is stated that natural resources and environmental administration system should adopt “A charge to project owners for reviewing environmental impact assessment (EIA) report, which should include but not limited to cost for report assessment and traveling cost for on-site assessment, based on beneficiary pay principle”. As to serve the plan, Office of Natural Resources and Environmental Policy and Planning (ONEP) by the Division of Environmental Impact Assessment Development conducts this study aiming to explore appropriate approach for charging IEE, EIA, and EHIA based on cost recovery method and beneficiary pay principle, which will enhance efficiency of government budgeting. The methodologies of this study are reviewing relevant literatures related to guideline for appraising charges for various assessment costs from both domestic and foreign sources and interviewing experts and relevant entities to the EIA system in Thailand to seek their opinion on the charging approaches. The study finds that the appropriate approach for charging for the EIA report reviewing is to charge it from project owners and should include only part of elements of the total cost, which are (a) an expense for arranging meeting for the expert committee to consider EIA report and (b) expense for the committee and ONEP staffs visiting the project sites. Moreover, there are more details to be considered such as the charge should cover the expenses for at least 3 committee meetings, and expenses for on-site assessment should be categorized based on travelling distances.
