ศึกษาแนวทางการจัดทำกฎหมายจัดตั้งองค์การอวกาศแห่งชาติ

Abstract

รายงานการศึกษาฉบับนี้มุ่งศึกษาเหตุผลความจำเป็นที่ประเทศต่าง ๆ ต่างจัดตั้งองค์การอวกาศแห่งชาติของตนขึ้น โดยมีเหตุผลหลากหลายประการตั้งแต่เรื่องเศรษฐกิจด้านอวกาศ ความมั่นคงปลอดภัยของประเทศด้านอวกาศ การส่งเสริมวิทยาการ วิจัยและพัฒนาด้านอวกาศ ตลอดจนเพื่อรองรับพันธกรณีระหว่างประเทศด้านอวกาศ จากนั้นได้ดำเนินการศึกษาเปรียบเทียบโครงสร้าง อำนาจหน้าที่และสถานะทางกฎหมายขององค์การอวกาศแห่งชาติของประเทศต่าง ๆ รวม 11 ประเทศ เพื่อศึกษาหาแนวทางการจัดตั้งองค์การอวกาศแห่งชาติที่เหมาะสมที่สุดกับบริบทของประเทศไทย ผลการศึกษาพบว่า สมควรจัดตั้งองค์การอวกาศแห่งชาติของไทยเป็นหน่วยงานของรัฐระดับพระราชบัญญัติในลักษณะองค์การของรัฐที่เป็นอิสระ (Independent administrative authority) ทำหน้าที่เป็นหน่วยงานกลางกิจการอวกาศของประเทศ โดยในระยะเริ่มแรกห้าปีของการจัดตั้งองค์การฯ กำหนดให้ทำหน้าที่ในฐานะผู้ประกอบการของรัฐในอุตสาหกรรมอวกาศ (operator) ในฐานะศูนย์กลางการศึกษาวิจัยและพัฒนาวิทยาการอวกาศ สนับสนุนส่งเสริมภาคเอกชนเพื่อผลักดันให้เกิดอุตสาหกรรมอวกาศในประเทศ (promotor) และทำหน้าที่ในฐานะองค์กรควบคุมกำกับกิจการอวกาศ ศูนย์ข้อมูลกิจการอวกาศและเป็นนายทะเบียนวัตถุอวกาศที่จดทะเบียนในประเทศไทย (regulator) แต่เมื่อพ้นระยะเวลาเริ่มแรกห้าปีไปแล้วให้มีการประเมินผลการปฏิบัติหน้าที่และแก้ไขปรับปรุงกฎหมายจัดตั้งองค์การอวกาศแห่งชาติอีกครั้งหนึ่ง ท้ายสุดรายงานฉบับนี้ได้นำเสนอร่างพระราชบัญญัติองค์การอวกาศแห่งชาติ พ.ศ. .... และแผนภูมิโครงสร้างองค์การฯ ซึ่งได้ยกร่างตามหลักการข้างต้น

This study examines the reasons for the countries to establish their own national space agencies. The outcomes of the examination were to create the space economy, securitize national security space defense and protection, encourage space research development, and to accommodate international obligations in space activities. Moreover, the mandates and legal status of the National Space Agencies of 11 countries across the world were investigated and compared to find out the model of the National Space Agency that is best suited to the context of Thailand. The result of the study suggested that the establishment of the National Space Agency of Thailand should be an Independent Administrative Authority acting as a central space agency. For the first five years of the establishment of the organization, it should act as the operator of the state in the space industry (Operator), as a center for space research and development advocating private sectors to invest in the national aerospace industry (Promoter) and act as a Regulator of space operations. However, at the end of the first five year period, the evaluation of the performance of duties and the law on the establishment of the National Space Agency should be revised. Attached with this report, the draft of National Space Agency Act and its Organization Chart which were developed accordingly to the above principles.
