ประเมินผลการจัดตั้งศูนย์ยุติธรรมชุมชนตำบลนำร่องในปีงบประมาณ 2557

Abstract

การวิจัยเรื่องการประเมินผลการจัดตั้งศูนย์ยุติธรรมชุมชนตำบลนำร่อง ในปีงบประมาณ พ.ศ.2557 เป็นการวิจัยเชิงประเมินผล โดยมีวัตถุประสงค์ในการวิจัยเพื่อประเมินคุณภาพของการจัดตั้งศูนย์ยุติธรรม ชุมชนตำบลนำร่องที่จัดตั้งขึ้นในปี พ.ศ.2557 จำนวน 312 ศูนย์ ในจังหวดนำร่องทั้งหมด 18 จังหวัด โดยดำเนินการศึกษาปัญหาและข้อจำกัดของกระบวนการจัดตั้งศูนย์ฯ และนำผลการประเมินดังกล่าวมาจัดทำเป็นข้อเสนอแนะสำหรับการขยายผลการจัดตั้งศูนย์ยุติธรรมชุมชนตำบลให้ครอบคลุมทั่วทั้งประเทศต่อไป ตามแผนการดาเนินงาน วิธีการที่ใช้ในการวิจัยประกอบด้วย การวิเคราะห์เอกสารและการสัมภาษณ์ผู้บริหารกระทรวงยุติธรรม ผู้บริหารระดับจังหวัด ระดับอำเภอ และระดับท้องถิ่นที่เกี่ยวข้อง ซึ่งผลการดำเนินงานวิจัยดังกล่าว ได้ปรากฏเป็นข้อเสนอแนะสำหรับการปรับปรุงคุณภาพของศูนย์ยุติธรรมชุมชนตำบลดังนี้ 1. ข้อเสนอแนะด้านกระบวนการจัดตั้งศูนย์ฯ กระบวนการจัดตั้งศูนย์ยุติธรรมชุมชนตำบล คือ ขั้นตอนแรกในการริเริ่มการบริหารงานศูนย์ยุติธรรมชุมชน หากการจัดตั้งมีคุณภาพตามเป้าหมายที่ ได้กำหนดไว้ หมายความว่า เป็นการเริ่มต้นที่มี คุณภาพ เปรียบเสมือนกับกระบวนการบริหารงานที่เริ่มต้นด้วยการให้ความสำคัญกับปัจจัยนำเข้า (Input) หากปัจจัยนำเข้ามีคุณภาพดี ย่อมส่งผลต่อกระบวนการดำเนินงานหรือการบริหารงาน (Process) ให้ดีและมีคุณภาพตามไปด้วย ในกรณีนี้ปัจจัยนำเข้าที่สำคัญของการจัดตั้งศูนย์ฯ ได้แก่ ทรัพยากรทางการบริหาร เช่น โครงสร้างบุคลากร (เจ้าหน้าที่และคณะกรรมการ) งบประมาณ วัสดุอปกรณ์ที่จำเป็นสำหรับการปฏบัติงาน สถานที่ปฏิบัติงาน เป็นต้น และจากข้อมูลที่คณะนักวิจัยรวบรวมมานั้น ปรากฏข้อเสนอแนะที่เป็นประโยชน์ มากมายต่อการปรับปรุงและพัฒนากระบวนการจัดตั้งศูนย์ยุติธรรมชุมชนตำบล ดังต่อไปนี้ การสรรหา คัดเลือกคณะกรรมการศูนย์ฯ และการประชาสัมพันธ์ศูนย์ฯ ให้เป็นที่รู้จักของประชาชนในชุมชน 2. ข้อเสนอแนะด้านการดำเนินงาน ศูนย์ยุติธรรมชุมชนตำบลนำร่อง จัดตั้งขึ้นเพื่ออำนวยความยุติธรรมให้กับประชาชนใน ชุมชนที่มักจะไม่มีโอกาสในการเข้าถึงความยุติธรรมในยามที่เกิดปัญหาที่เป็นคดีความ โดยยึดถือกรอบภารกิจ5 ด้าน เป็นแนวทางในการดำเนินงานของศูนย์ฯ ผ่านการดำเนินงานโครงการและการจัดกิจกรรมตามภารกิจ ซึ่งสำนักงานยุติธรรมจังหวัดได้จัดสรรงบประมาณให้กับศูนย์ยุติธรรมชุมชนตำบลนำร่องศูนย์ละ 25,000 บาท ซึ่งผลการดำเนินงานของศูนย์ยุติธรรมชุมชนตำบลนำร่องที่ผ่านมา คณะนักวิจัยได้เก็บรวบรวมข้อมูล และนำมาวิเคราะห์ผล จนกระทั่งได้ข้อเสนอแนะในด้านการดำเนินงานของศูนย์ฯ ดังนี้ เสริมสร้างการมีส่วนร่วม เสริมสร้างความรู้ ความเข้าใจด้านกฎหมายให้กับคณะกรรมการศูนย์ฯ เป็นต้น ทั้งนี้ ข้อเสนอแนะในการจัดตั้งศูนย์ยุติธรรมชุมชนตำบลที่เป็นผลมาจากการดำเนินการวิจัยในโครงการนี้ ทางกระทรวงยุติธรรมจะสามารถนาไปใช้เป็นกรอบแนวทางในการพัฒนาและขยายผลการจัดตั้งศูนย์ยุติธรรมชุมชนตำบลให้มีคุณภาพต่อไป

This research was regarding the evaluation of the Pilot Community Justice Center, the set up processes of a sub navigation in a fiscal year 2557 (2014), the objective of the research was to assess the quality of research in the set up process of the Community Justice Center in pilot districts that form in 312 centers in 18 pilot provinces by conducting studies, problems, and constraints of the Centre and the set up process to evaluate the effects of such a suggestion for the setup of the expanded community justice centers across the country, according to plan operations. The methods used in the research contains Document analysis and interviews Ministry of Justice’s Executive, managers and district level local province related research results, it appears to be a suggestion for improving the quality of Community Justice Center, as follows 1. The suggestion of Community Justice Center setup process. The set up process of community justice center is the first process of center management. If this processes according to standard quality, It’s mean the best management. This processes are begining with quality of input will be impact to the best management processes. In this research, the important management input is management resources such as personal structure (committee), budget, needs materials, place. From data of research are appearance the useful suggestions to apply and develop the Community Justice Center forming processes, such as recruit process and public relation process. 2. The suggestion of Operation. Community Justice Center was set up to delivered the justice service for people in community, who don’t have a chance to receive the service from center department. This service hold to 5 justice missions principle to design the community justice center operation, by set project or activities. This project or activities are support by Province Justice Office to give the budget amount 25,000 baht to each Community Justice Center. The researcher collected and analyzed data of Community Justice Center operation, until to obtain the suggestion in community justice operation. Such as process to reinforce participatory, process to develop the knowledge and understanding of law to the committee. According to the suggestion of Community Justice Center setup processes. That be beneficial for Ministry of Justice to improve the quality process of set up and operation continually.
